Fatal Virginia accident leads to DUI, other criminal charges

Car accidents can happen at any time of the day or night and for a variety of different reasons. As such, drivers and passengers in Virginia often take certain action -- such as wearing a safety belt -- to protect themselves in the event of an accident. Unfortunately, one man now faces charges of DUI, among others, after a passenger in his vehicle reportedly died in a traffic accident.

The incident happened during the early morning hours of a day in early November. Police reportedly responded to reports of a single-vehicle crash. Reports claim that a 27-year-old male driving a pickup truck failed to negotiate a turn, causing the vehicle to exit the roadway, overturn and strike trees.

A 29-year-old male in the truck was reportedly not wearing a safety belt, and he was ejected from the vehicle during the collision. He died at the scene. Law enforcement officials, including the Virginia State Police Crash Reconstruction Team, are still investigating the incident.

In addition to the DUI charge, the man also faces charges of DUI manslaughter, felon in possession of a firearm, reckless driving and failure to wear a seat belt. Despite the accusations, it is unclear what the man's blood alcohol content was at the time of the accident and how it was determined. Regardless of the claims made by Virginia law enforcement officers, the man is considered not guilty unless sufficient evidence is provided to prove otherwise. A careful review of any evidence with an experienced attorney can help them determine how to best proceed.
