Charged With a Crime Involving Alcohol? Roanoke Criminal Defense Attorney, Bob Rider, Can Help.

Alcohol crimes in Virginia tend to focus on those who are underage or drink in public. Although crimes related to alcohol are often charged as misdemeanors with fines of up to $250, underage drinkers may face stiffer penalties including higher fines, probation, community service, and potential driver's license suspension.

  • In Virginia, the legal age to drink alcohol is 21, and it is illegal for anyone under age 21 to purchase, possess, or attempt to purchase or possess any alcoholic beverage. Violators are guilty of a Class 1 misdemeanor and, upon conviction, face a fine up to $2,500, and/or a year in jail, and/or 50 hours of community service. They can also lose their drivers license for up to one year, and the court may order substance abuse counseling and treatment.
  • It is illegal for adults, including parents, to serve alcohol to guests or children in their home unless they are 21 years old or older or are accompanied by a parent, guardian, or spouse who is 21 or older. It is also illegal for any person to purchase or provide alcoholic beverages to another person whom they know to be under 21. Doing so is a Class 1 misdemeanor.
  • Using a fake ID to purchase alcoholic beverages is a Class 1 misdemeanor punishable by a fine of up to $2,500, and/or one year in jail and a minimum $500 fine or 50 hours of community service, and loss of driver's license for up to one year.
  • Virginia has a Zero Tolerance policy when it comes to DUIs, and has some of the toughest laws in the U.S. when it comes to minors driving under the influence of alcohol and/or drugs. Any person under the age of 21 who operates a motor vehicle after consuming alcohol is guilty of a Class 1 misdemeanor, punishable by loss of driver's license for one year and a mandatory minimum fine of $500 or having to perform a minimum of 50 hours of community service.
